Welcome to Gatherly ("Gatherly", "we", "our", or "us").

These Terms of Use ("Terms") govern your access to and use of the Gatherly website, mobile applications, services, content, features, and related platforms (collectively, the "Platform").

2. About Gatherly

Gatherly is a discovery and marketplace platform that helps users find, compare, save, organise, enquire about, and book activities, events, experiences, services, venues, programmes, and family-friendly opportunities.

Gatherly acts primarily as a technology platform connecting users with independent activity providers, organisers, venues, businesses, and service providers.

Unless expressly stated otherwise, Gatherly does not own, operate, supervise, manage, inspect, or control activities listed on the Platform.

3. Eligibility

To use Gatherly, you must:

  • Be at least 18 years old
  • Have authority to enter legally binding agreements
  • Provide accurate and complete information
  • Comply with applicable laws

Parents and guardians are responsible for information submitted regarding children participating in activities.

4. User Accounts

You are responsible for:

  • Maintaining account security
  • Protecting login credentials

  • Ensuring all information is accurate
  • All activity occurring under your account

Gatherly may suspend, restrict, verify, or terminate accounts at its discretion.

5. Marketplace Nature of the Platform

Gatherly connects users with independent providers only.

Providers are solely responsible for:

  • Delivering services
  • Safety and supervision
  • Staffing and operations
  • Qualifications and competence
  • Insurance and legal compliance
  • Venue and activity management

Gatherly does not guarantee:

  • Provider quality or safety
  • Suitability or accuracy of activities
  • Availability or scheduling
  • Outcomes or user satisfaction

Users must independently assess suitability before participating.

6. Bookings and Reservations

Gatherly may facilitate:

  • Bookings
  • Registrations
  • Enquiries
  • Waitlists
  • Ticket purchases

A booking is not guaranteed until confirmed by the provider.

Bookings may depend on availability, eligibility, safety requirements, and provider policies.

Gatherly may cancel or modify bookings where necessary.

7. Cancellations, Refunds and Disputes

Cancellation and refund outcomes depend on:

  • Provider policies
  • Timing
  • Event conditions
  • Applicable law

Gatherly may assist with disputes but does not guarantee refunds unless explicitly stated.

We may investigate booking disputes, chargebacks, and complaints.

8. Future Payment Services

Gatherly may introduce:

  • Online payments
  • Deposits
  • Subscriptions (provider-only)
  • Memberships (provider-only)
  • Gift cards
  • Loyalty programs
  • Marketplace transactions
  • Credits and rewards
  • Provider payout systems

9. User Conduct

You must not:

  • Break laws
  • Provide false information
  • Harass or abuse others
  • Upload illegal content
  • Attempt unauthorised access
  • Scrape or copy platform data
  • Interfere with platform systems
  • Engage in fraud

We may remove content or suspend accounts immediately for violations.

10. Reviews and User Content

Users may post:

  • Ratings
  • Comments
  • Images
  • Feedback

You must ensure content is:

  • Honest
  • Lawful
  • Non-defamatory
  • Not misleading

Providers are fully responsible for:

  • Descriptions and media
  • Promotional claims

Gatherly may edit, remove, or suspend listings at its discretion.

12. Photos, Media and Permissions

Providers must ensure they have all rights, licences, and consents to upload content.

This includes permissions relating to individuals, children, photographers, and copyright holders.

We may remove content if legal, privacy, or consent concerns arise.

13. Consumer Rights

Nothing in these Terms excludes, restricts, or modifies any rights under applicable law, including the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

14. Activity Information Disclaimer

Information on Gatherly is provided by independent providers.

We do not guarantee that listings are accurate, complete, or up to date, including:

  • Pricing
  • Availability
  • Age suitability
  • Safety information
  • Event details

Users must confirm details directly with providers.

15. Child Supervision Disclaimer

Parents, guardians, or responsible adults are solely responsible for supervising children unless a provider explicitly states otherwise.

Gatherly does not supervise children or activities.

16. Provider Non-Endorsement

Listing a provider does not mean Gatherly:

  • Endorses them
  • Verifies them
  • Certifies them
  • Guarantees safety, quality, or suitability

All providers operate independently.

17. Provider Insurance and Compliance

Providers are responsible for:

  • Insurance
  • Licences
  • Legal compliance
  • Certifications

We may request proof but do not independently verify compliance.

18. AI Recommendations Disclaimer

Gatherly may use AI or automated systems for:

  • Recommendations
  • Rankings
  • Itineraries
  • Search results

These outputs are informational only and not professional advice.

Users are responsible for their decisions.

19. Provider Memberships and Paid Services

Gatherly may offer paid services only to providers, including:

  • Featured listings
  • Advertising
  • Subscriptions
  • Analytics tools
  • Booking tools

We may change pricing or features at any time.

We do not guarantee:

  • Bookings
  • Leads
  • Revenue
  • Views or clicks

20. Partner Offers and Discounts

Third-party offers may change or be withdrawn at any time.

Gatherly is not responsible for provider promotions or discount availability.

21. Business Verification

We may conduct identity checks, business verification, and fraud prevention checks.

We may suspend accounts if verification is not completed.

22. Third-Party Services

We are not responsible for third-party platforms, websites, or services linked through Gatherly.

Use them at your own risk.

23. Assumption of Risk

Participation in activities may involve risks including injury, illness, or property damage.

Users voluntarily accept these risks.

Parents are responsible for assessing suitability for children.

24. Limitation of Liability

To the maximum extent permitted by law, Gatherly is not liable for:

Gatherly is not responsible for the actions, conduct, services, safety, or policies of independent providers or third parties.

You agree to indemnify Gatherly against claims arising from:

  • Provider disputes involving you
  • Legal breaches

27. Suspension and Termination

We may suspend or terminate accounts, listings, or access at any time if necessary.

No prior notice is required.

We may introduce new features including:
